正義女神如何掂量六輕的排氣？雲林台西居民向台塑民事求償之法庭觀察報告

摘要：

台塑六輕是位於雲林麥寮的大型離島式石化工業區，自 1998 年正式營運 至今，由於經年累月地排放其工業製程所產出的廢氣，首當其衝受到嚴重影 響的就是工業區周遭的在地居民，本件控告台塑五家公司的居民，許多皆已罹 癌，或者已經往生而由家屬後代出面對台塑追究民事侵權賠償責任。筆者曾多 次前往雲林地院參與這起爭訟的法庭觀察，儘管一審截至目前為止進展有限， 但筆者仍試圖整理原告與被告律師團的數個爭點，盼讀者能夠稍微了解過去這 12 次庭期的攻防。

How should the Goddess of Justice rule in a Pollution Case in Yunlin? A Court Watch Report on Formosa Petrochemical Corporation’s Sixth Naphtha Cracking Plant

Abstract：

Formosa Petrochemical Corporation’s Sixth Naphtha Cracking Plant located in Mailiao, Yunlin County began operating in 1998 spewing poisonous gases around the clock. These gases have seriously damaged residents’ health. Some of the plaintiffs in a case the author watched have been diagnosed with cancer while others, who have since died, are represented by members of their family. They claim the FPC is liable under civil law. The debates on both sides throughout the present 12 sittings are analysed here. The case continues.
