當世界早已肯認勞工與工會之罷工權作為基本人權的一環而應受到保障 時，在長達 37 年戒嚴體制全面禁止以及後續制度遺緒的影響，台灣的勞工與 工會罷工權的行使依然受到高度的限制，幾乎是全世界罷工頻率最低的國家。 而 2019 年所出現的兩場分別由機師與空服員發起之罷工行動，引發了資方團 體意圖進一步對罷工權行使進行限縮的壓力。本文除了概略歸納兩場同為航空 業受僱勞工所發動之罷工行動背後相似的勞資關係背景外，也將試圖提出三點 當前擴大、保障台灣勞工與工會罷工權行使可能的努力方向。

Although the right to strike has already been admitted as a fundamental human right worldwide, strike action has been highly restricted in Taiwan owing to a ban on strikes after 37 years Martial Law period from 1949 to 1987. As a result, the frequency of strike action in Taiwan is almost one of the lowest in the world. In 2019, because the pilots of China Airlines and the flight attendants of Eva Air launched strike action in February and June, corporations and capitalists angrily sought to limit the right to strike further. This article compares the background and cause of these two strikes in 2019. The author also proposes three possible ways to promote and protect the right to strike in Taiwan.
